1. Agreement to Terms
By using MakaaziLink, you agree to these Terms of Service. If you are using the platform on behalf of a property owner, company, or agency, you confirm that you have authority to act on their behalf.
2. Definitions
Property Manager refers to any landlord, landlady, agent, or representative responsible for managing a rental unit listed on MakaaziLink.
Tenant refers to any individual renting or intending to rent a unit through the platform.
Platform refers to the MakaaziLink application and services.
3. Digital Signatures
MakaaziLink enables digital signing of tenancy agreements. By signing electronically, you agree that your signature is legally valid under applicable Kenyan law and carries the same effect as a handwritten signature.
4. Rent Payments
- Users must confirm payment details before completing transactions.
- MakaaziLink does not reverse M-Pesa or bank payments.
- Receipts generated within the platform serve as proof of payment.
- Any disputes must be resolved directly between the Tenant and the Property Manager.
5. Chat and Communication
The platform provides a messaging feature between Tenants and Property Managers.
- Users must communicate respectfully and honestly.
- Fraudulent, abusive, or misleading communication is not allowed.
MakaaziLink does not actively monitor conversations and is not responsible for user communication. However, reported misuse may lead to account action.
6. Tenancy Agreements
Tenancy agreements are created and signed based on information provided by users.
- Users are responsible for reviewing all terms before signing.
- MakaaziLink does not verify or enforce agreement content.
7. Vacant Units and Listings
MakaaziLink manages unit availability based on tenancy activity recorded within the platform. When a tenant is checked in or marked as vacated, the system may automatically update the unit’s availability status to reflect whether it is occupied or vacant.
To maintain accurate listings, Property Managers are required to promptly update tenant check-in and vacation status as they occur. Any delay or failure to record these changes may result in incorrect availability being displayed on the platform.
Property Managers are fully responsible for ensuring that:
- All unit information is accurate, complete, and up to date
- Vacancy status reflects the actual condition of the unit
- They have the authority to list and manage the property
MakaaziLink does not independently verify property listings and relies on the accuracy of information provided by Property Managers. We are not responsible for any errors, omissions, or outdated information resulting from delayed or incorrect updates.
To protect the integrity of the platform, MakaaziLink reserves the right to investigate any listing that appears to contain false or misleading information. Where necessary, we may take appropriate action, including:
- Requesting clarification or supporting information
- Removing or suspending the listing
- Restricting or suspending account access
- Terminating accounts in cases of repeated or serious violations
These measures are intended to maintain accurate listings and ensure a reliable experience for all users of the platform.
8. Maintenance Requests
Tenants may submit maintenance requests through the platform. MakaaziLink forwards these requests to the Property Manager.
We do not perform repairs and are not responsible for the quality or timing of maintenance work.
9. Data Privacy
We collect personal information necessary to operate the platform, such as names, identification details, and contact information.
This data is securely stored and is not sold to third parties. Please refer to our Privacy Policy for more information
10. Prohibited Use
- Providing false or misleading information
- Uploading fake payment confirmations
- Engaging in fraud or illegal activity
- Harassing or abusing other users
11. Our Role on the Platform
MakaaziLink is designed to support rental management by providing tools for communication, payments, agreements, and record keeping.
While we aim to make these processes simple and reliable, it is important to understand the role of the platform:
- MakaaziLink does not own or manage any properties listed on the platform
- We are not a party to tenancy agreements between Property Managers and Tenants
- We do not make decisions regarding rental terms, occupancy, or property conditions
We are committed to providing a reliable system and maintaining accurate records where possible. However, any disputes, damages, or losses that arise between users remain the responsibility of the parties involved.
Where issues arise, we encourage users to resolve them directly, and we may assist by providing relevant records available within the platform.
12. Changes to These Terms
We may update these Terms from time to time to reflect improvements to the platform, changes in the law, or feedback from our users.
Where changes are significant, we will make reasonable efforts to notify you through the platform or other appropriate channels.
Your continued use of MakaaziLink after any updates means that you accept the revised Terms.
